Terms of Service

1. Acceptance
By downloading, installing, or using SmartRestro POS ("the Software"), you agree to these terms. If you don't agree, don't use the Software.
2. License
- Free plan: perpetual personal license to use the Free tier on one device.
- PRO plan: paid license bound to one device. 1 license = 1 POS device. You can self-release and re-bind via your dashboard (rate-limited to 3 times per 30 days).
- Lifetime plan: perpetual PRO use of the local app; cloud backups included for 3 years from purchase, renewable for Rs 10,000/3 years.
- You may NOT resell, sublicense, or distribute license keys.
3. Payments
- Prices are in Pakistani Rupees (PKR), inclusive of any applicable taxes.
- Payments are made via bank transfer, JazzCash, or Easypaisa (account details shown on your upgrade page after signup).
- License is delivered after we manually verify your payment proof — typically within 2-4 hours during business hours.
4. Refunds
- 14-day refund: if the Software doesn't work as advertised, email us within 14 days of purchase. We'll refund in full and revoke the license.
- After 14 days: no refunds, but we honor backup-renewal pricing for Lifetime users.
- Refund processed via the same payment method, within 7 business days.
5. Your responsibilities
- Keep your password and license key confidential.
- Run regular local backups (we provide one-click backup; PRO does it automatically).
- Comply with Pakistan FBR / tax regulations applicable to your business. We provide the tools; we don't file taxes on your behalf.
- Don't use the Software for illegal activity.
6. Service availability
- Your local POS works offline 100% — internet is only needed for license activation, cloud backup, and dashboard.
- Cloud services target 99% uptime but are provided "as is". We do not guarantee uninterrupted access.
- We may schedule maintenance with prior notice via email.
7. Updates
- The Software auto-checks for updates and prompts you to install. You can decline.
- Free updates are included with your active license. Major version changes (e.g. v2.0) may require a separate upgrade for PRO/Lifetime parity — we'll notify you at least 30 days in advance.
8. Data ownership
- Your restaurant data (sales, products, customers) is YOURS.
- We host cloud backups on your behalf but never sell or share them. See our Privacy Policy.
- On account closure, we provide an export and delete all your data within 7 days.
9. Limitation of liability
The Software is provided "as is" without warranty. We are not liable for indirect, incidental, or consequential damages (e.g. lost profits) arising from use of the Software. Our maximum liability in any case is capped at the amount you paid us in the preceding 12 months.
10. Termination
We may suspend or terminate your account if you violate these terms (e.g. reselling licenses, abusive support requests). You may cancel anytime by emailing support — no refund after 14 days, but your local Software keeps working with whatever features were unlocked.
11. Governing law
These terms are governed by the laws of the Islamic Republic of Pakistan. Disputes shall be resolved in the courts of Karachi.
